Declaration of Conformity for packaging becomes mandatory
The European Packaging Regulation (EU) 2025/40 (the so-called PPWR) stipulates that from August 12th 2026, packaging may no longer be placed on the market without a Declaration of Conformity.
It should also be noted that non-compliant packaging affects the packed goods themselves. This requirement therefore presents many companies with the challenge of providing the necessary proof both in full and on time.
An obvious and necessary approach is to first collect data from suppliers. However, this step alone may fall short.
The Declaration of Conformity is not the result of a data collection project. It requires internal structures and clear, ongoing processes for data collection and evaluation.
From our perspective, the following points are decisive:
a) A clear definition of your own scope (types of packaging, materials, roles)
b) The establishment of a binding and structured approach to data collection, processing and evaluation
c) A systematic prioritization of actions and coverage of packaging
d) Ensuring the robustness of data and results
e) Documentation of the approach, results, gaps and ongoing measures
Supplier data is an important element in this process. However, it is primarily an input.
The actual compliance of the respective economic operator, in accordance with Article 3(12) of the PPWR, arises from their ability to validate this data and place it within their own regulatory context.
Without control over the process, there is ultimately no control over the result.
The PPWR Declaration of Conformity will therefore, for many companies, become less a question of data collection and more a question of organization.
12 August 2026 is not only a deadline.
It is the point from which packaging without a valid Declaration of Conformity may no longer be placed on the market. At the same time, it marks the starting point for establishing robust structures to provide initial evidence in accordance with the PPWR.
Now is the time to create the necessary foundations.
